Trademark renewals are crucial for maintaining and reinforcing trademark protection under the USPTO. All trademark registration owners are required to file a Declaration of Use and/or Excusable Nonuse Under Section 8.

Optionally, if the trademark owner can claim the benefits of incontestability, the owner may file an optional Declaration of Incontestability Under Section 15.

The Section 8 and 15 renewal may be combined by filing a Combined Declaration of Use and Incontestability Under Sections 8 and 15 (Combined Sections 8 and 15 Declaration).

 

What is the Declaration of Use and/or Excusable Nonuse Under Section 8?
The Section 8 declaration, required between the 5th and 6th year after registration and every ten years thereafter, confirms your trademark’s continued use in commerce. Failure to file it can lead to cancellation.

 

What is the Declaration of Incontestability Under Section 15?
The Section 15 declaration, which can be filed after five years of continuous use, grants the trademark incontestable status, significantly strengthening its legal protections. Together, these filings help ensure the trademark remains active and safeguarded under U.S. law.

 

How long will the trademark renewal process take?
Your trademark registration maintenance documents normally do not take more than a week to be filed. Once the registration maintenance documents are filed, it will take at least 2-3 months to have renewal confirmation from the USPTO.
